Welcome to Magnos Gold. The terms “we,” “us” and “our” refer to Magnos Gold, owned by Andreas Strittmatter.
Magnos Gold operates this online store and website. The store is hosted by Shopify.
These Terms and Conditions apply to orders placed through our online store and govern the contractual relationship between you and Magnos Gold.
Section 1 – Scope
These Terms and Conditions apply to all orders placed by consumers through the Magnos Gold online store.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or independent professional activity.
Section 2 – Our Products
We make every effort to display our products as accurately as possible in our online store. However, colors and appearance may differ slightly from the actual goods depending on your screen and its settings.
Natural stones, mother-of-pearl, pearls and other natural materials may naturally vary in color, structure, shimmer, shape and inclusions. These variations make each piece of jewelry unique.
The essential characteristics of each product are set out in its product description.
Section 3 – Orders and Conclusion of the Contract
The display of our products in the online store does not constitute a binding offer to enter into a purchase contract.
By submitting your order using the designated order button, you make a binding offer to purchase the goods in your cart.
After we receive your order, you will receive an automatic email confirming its receipt. This acknowledgment of receipt does not constitute acceptance of your purchase offer.
The purchase contract is concluded when we accept your order through a separate order confirmation or dispatch the ordered goods.
Before submitting your order, you can review and, if necessary, correct your order details during the checkout process provided by Shopify. You can save or print the contractual terms before concluding the contract using your browser’s functions.
After we receive your order, we will send you the order details and information relevant to the conclusion of the contract by email.
The contract is concluded in German.
Section 4 – Prices and Payment
The prices shown in the online store are final prices.
Standard delivery within the European Union is free of charge.
The available payment methods are displayed during checkout.
Payment is made using the payment method you select.
Section 5 – Shipping and Delivery
We deliver within the European Union.
Standard shipping within the European Union is free.
Unless a different delivery time is stated on the product page, estimated delivery times are:
Germany: approximately 1–7 business days
Rest of the European Union: approximately 3–10 business days
Delivery times depend on the destination country and the shipping carrier.
Please note that deliveries generally do not take place on Sundays or public holidays. Public holidays vary by destination country.
If you order several items with different delivery times and we ship them together, the delivery time will generally be based on the item with the longest delivery time.
If we ship your order in multiple packages, you will not incur any additional shipping costs.
If an item you ordered is unexpectedly unavailable or delivery is significantly delayed, we will inform you when we become aware of it.
If you are a consumer, the risk of accidental loss of or damage to the goods during shipping generally passes to you only when the goods are handed over to you or a recipient designated by you. This does not apply if you independently commissioned a carrier that we had not previously named to you.
Section 6 – Retention of Title
The goods remain our property until payment has been received in full.
Section 7 – Right of Withdrawal
Consumers have a statutory right of withdrawal.
Information on the conditions, deadlines and consequences of withdrawal, as well as the model withdrawal form, can be found in our separate Returns & Withdrawal Policy.
The consumer bears the direct cost of returning the goods in the event of withdrawal, provided the consumer has been properly informed of this.
Section 8 – Statutory Rights for Defective Goods
Statutory rights in relation to defective goods apply.
These Terms and Conditions do not limit consumers’ statutory rights if goods are defective.
Section 9 – Intellectual Property
The content provided through our online store, including text, images, graphics, logos, product descriptions, designs and other content, is protected under applicable law.
Reproducing, editing, distributing or otherwise using this content beyond what is permitted by law requires the prior consent of the relevant rights holder.
Section 10 – Optional Tools and External Services
Our online store may provide services, features or tools from third parties.
The terms and privacy policies of the relevant third parties may also apply to those services.
Consumers’ statutory rights against Magnos Gold remain unaffected.
Section 11 – External Links
Our online store may contain links to third-party websites or services.
The respective operators are generally responsible for the content of external websites. Statutory liability obligations remain unaffected.
Section 12 – Relationship with Shopify
Magnos Gold runs on Shopify, which provides the technical infrastructure for our online store.
However, purchase contracts for products offered in our store are concluded between you and Magnos Gold. Shopify is not the seller of products offered by Magnos Gold.
Section 13 – Privacy
Information on how personal data is processed in connection with our online store can be found in our Privacy Policy.
The online store runs on Shopify. Further information about Shopify’s processing of personal data can be found in Shopify’s privacy notices.
Section 14 – Reviews and Feedback
If you submit reviews, comments or other content through our online store, that content must not infringe third-party rights or violate applicable law.
To the extent necessary to display and use a review you voluntarily publish, you grant us the rights of use required for that purpose.
Section 15 – Errors and Inaccuracies
Despite careful maintenance, information in our online store may occasionally be incorrect or incomplete.
Obvious typographical, calculation or display errors may be corrected. Your statutory rights remain unaffected.
Section 16 – Prohibited Use
The online store must not be used for unlawful purposes or in a way that infringes the rights of Magnos Gold, Shopify or third parties.
In particular, you must not transmit malware or other harmful content or bypass technical security measures without authorization.
Section 17 – Liability
Magnos Gold is liable without limitation for damage resulting from injury to life, body or health caused by an intentional or negligent breach of duty.
For other damage, Magnos Gold is liable without limitation in cases of intent or gross negligence.
In the event of a slightly negligent breach of essential contractual obligations, liability is limited to damage that is typical of the contract and foreseeable.
Mandatory statutory liability, particularly under product liability law, remains unaffected.
Section 18 – Severability
If any provision of these Terms and Conditions is or becomes wholly or partly invalid, the remaining provisions remain effective.
The statutory provisions apply in place of the invalid provision.
Section 19 – Applicable Law
The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods.
For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they habitually reside.
Section 20 – Changes to These Terms and Conditions
The current version of these Terms and Conditions is available through our online store.
For purchase contracts already concluded, the version of the Terms and Conditions incorporated at the time the contract was concluded generally applies.
